General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Digital Airways GmbH and our customers, based on the Swiss Code of Obligations (CO).

2. Conclusion of contract

Offers from Digital Airways GmbH are non-binding.

The contract is concluded as soon as we confirm your order in writing or by delivery.

3. Services

We offer standard and customized solutions for the digitalization of SMEs. Our services include consulting, implementation, and support in the use of digital technologies, exclusively Microsoft technology, to increase business success.

4. Prices and payment

• All prices are subject to statutory VAT.

• Payments are due no later than 30 days after invoicing.

• Payment default occurs if the invoice is not paid by the due date.

5. Delivery and provision of services

• Delivery dates are non-binding unless they have been expressly agreed as binding.

• Digital Airways GmbH is not liable for delays due to force majeure or other unforeseeable events.

6. Warranty and Liability

• The statutory warranty rights under Swiss law apply.

• Digital Airways GmbH is only liable for damages resulting from intent or gross negligence, with the exception of damages resulting from injury to life, body or health.

7. Right of withdrawal

Customers who are consumers within the meaning of Swiss law have a right of withdrawal, provided this is provided for by law. The withdrawal period is 14 days from the conclusion of the contract, unless otherwise agreed.

8. Data protection

Personal data is processed in accordance with our privacy policy and the provisions of the Swiss Data Protection Act (DSG).

9. Final provisions

• Swiss law applies exclusively.

• The place of jurisdiction is Münchenstein, provided that the customer is a merchant or an express place of jurisdiction has been agreed.

• Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
